1. Acceptance of Terms

By accessing, browsing, or purchasing from McGreen Acres (“we,” “us,” “our”), you agree to be bound by these Terms and Conditions and all applicable policies referenced herein.

If you do not agree to these Terms, you may not use our website or services.

2. Eligibility

You must be at least 18 years old to place orders, enroll in subscriptions, or participate in herd share programs.

By using this website, you represent that you meet this requirement.

3. Products and Services

McGreen Acres offers farm products, subscriptions, and related services through its website and in-person channels.

All offerings are subject to availability and may be modified, limited, or discontinued at any time without notice.

We reserve the right to refuse service to any individual for lawful business reasons.

4. Orders and Payments

4.1 Online Orders

Orders placed through our website constitute an offer to purchase.

We reserve the right to accept, decline, or cancel any order at our discretion.

Payment must be received in full before order fulfillment unless otherwise agreed in writing.

4.2 Subscriptions

Subscription services are billed on a recurring basis according to the selected plan on the first of the month. If a subscription is started beyond the first of the month, that first month is prorated.

By enrolling, you authorize automatic charges until canceled in accordance with our cancellation policy.

Failed payments may result in suspension or termination of service.

4.3 Pricing and Errors

All prices are subject to change without notice.

We are not responsible for typographical or pricing errors and reserve the right to correct them.

5. Order Fulfillment and Pickup

Many orders require customer pickup.

Customers are responsible for monitoring communications regarding fulfillment.

If an order requires pickup:

  • We will attempt to contact the customer via SMS/text, phone, and email

  • Up to three (3) contact attempts may be made

  • We will wait up to ten (10) calendar days for response or pickup

If no contact is established within ten (10) days, the order may be canceled and refunded minus a three percent (3%) restocking/processing fee.

Perishable items may be discarded earlier when necessary for safety or quality.

6. Returns and Refunds

Returns and refunds are governed by our published Return Policy.

Refunds, when applicable, are issued to the original payment method.

Processing fees and administrative costs may be deducted where permitted.

7. Herd Share Programs

Participation in any herd share or raw milk-related program is governed by a separate Bovine Agistment Agreement and related documents (“Herd Share Agreement”).

Enrollment requires execution and compliance with the applicable agreement.

In the event of any conflict between these Terms and a Herd Share Agreement, the Herd Share Agreement shall govern.

Failure to comply with herd share obligations, payment requirements, or pickup rules may result in suspension or termination of participation.

8. Communications and Notices

By placing an order, creating an account, or enrolling in services, you consent to receive communications from McGreen Acres related to:

  • Order fulfillment

  • Pickup coordination

  • Billing and payment issues

  • Subscription management

  • Herd share compliance

Communications may be delivered via SMS/text message, phone call, and email.

Promotional communications are governed separately and may be opted out of at any time.

Operational communications are required for service delivery and cannot be fully opted out of while maintaining an active account or subscription.

9. Customer Responsibilities

Customers agree to:

  • Provide accurate and current contact information

  • Monitor communications

  • Pick up orders promptly

  • Comply with posted policies

  • Follow herd share agreements where applicable

Failure to do so may result in delays, forfeiture, or account termination.

10. Health and Product Disclaimers

Farm products are produced in an agricultural environment.

Natural variation may occur.

We make no medical, dietary, or health claims.

Consumption of farm products is at the customer’s own risk.

11. Limitation of Liability

To the fullest extent permitted by law, McGreen Acres shall not be liable for indirect, incidental, or consequential damages arising from the use of our website, products, or services.

Our total liability shall not exceed the amount paid for the applicable order.

12. Indemnification

You agree to indemnify and hold harmless McGreen Acres, its owners, and employees from any claims arising from your use of our services or violation of these Terms.

13. Intellectual Property

All website content, logos, images, and materials are the property of McGreen Acres and may not be used without written permission.

14. Termination

We may suspend or terminate access to services at our discretion for policy violations, nonpayment, or misuse.

Outstanding balances remain due upon termination.

15. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

16. Changes to Terms

We may update these Terms at any time.

Continued use constitutes acceptance of revised Terms.
